Quotation Terms & Conditions

The standard terms on which Sorian Cranes issues quotations and accepts orders.

1. Quotation validity

Unless otherwise stated on the face of the quotation, prices are valid for 30 days from the date of issue. After this period, we may re-quote to reflect changes in material costs, exchange rates, or subcontract rates.

2. Currency and tax

All prices are in Australian Dollars (AUD), exclusive of GST unless stated otherwise. GST will be added to invoices at the prevailing rate.

3. Scope and exclusions

The scope of work is as described in the quotation. Items not explicitly included are excluded, including but not limited to:

  • structural assessment or strengthening of existing building steel beyond the support points we nominate;
  • civil works and footings for free-standing JIB pillars (unless specifically noted);
  • power supply provision beyond the termination point we nominate;
  • crane lift engineering and rigging for installation where the client retains site possession;
  • removal or disposal of existing plant;
  • consumables and site-protection costs not specifically listed.

4. Compliance basis

All cranes are designed and supplied to:

  • AS 1418.1 — Cranes, hoists and winches — General requirements;
  • AS 5229.1 — Slewing jib cranes (where applicable);
  • AS 1418.3 — Bridge and gantry cranes (where applicable);
  • AS 3990 — Mechanical equipment steelwork (working-stress permissibles);
  • AS/NZS 1554 — Structural steel welding;
  • AS/NZS 1170 — environmental loads (wind, where outdoor or cyclone-region applies);
  • the relevant Work Health and Safety Acts and associated regulations.

Duty class is specified in the quotation per AS 1418.1. Where a client brief does not specify duty class we apply M5 as a default; this must be confirmed before order.

5. Engineering documentation

Every Sorian crane ships with the following documentation:

  • Engineering report (AS 5229.1 / AS 1418.1 / AS 3990 strength and dynamic-factor check);
  • Welding ITP per AS/NZS 1554;
  • 125 % MRC static load-test certificate;
  • Operations and maintenance manual;
  • Nameplate stamping conforming to AS 1418.

6. Load testing

Every crane is subjected to a static load test at 125 % of Maximum Rated Capacity (MRC) before despatch or commissioning, in accordance with AS 1418. Test reports form part of the handover documentation.

7. Variations and change orders

Any change to the scope after order acceptance — including capacity increase, reach change, duty class upgrade, or added features — requires a written variation. We will issue a priced variation for acceptance before work proceeds. Work performed outside the quoted scope without a written variation is chargeable at our then-current day rates.

8. Delivery and Incoterms

Unless otherwise stated, cranes are supplied ex-works from our nominated workshop. Transport and insurance in transit are at the client's risk and cost. Where installation is included in our scope, we engage appropriate carriers and the site-delivery point will be nominated in the quotation.

9. Installation

Where installation is included, the client is responsible for providing safe site access, compliant electrical supply to the nominated termination point, and any required site inductions at no charge to us. Delays arising from site-readiness issues outside our control are chargeable at day rates plus standby for equipment on site.

10. Warranty

We warrant cranes supplied by us to be free of defects in materials and workmanship for 24 months from the date of commissioning (or 30 months from date of despatch if commissioning is delayed by the client). The warranty covers like-for-like replacement or repair at our discretion, provided the crane has been maintained and serviced in accordance with our operations and maintenance manual and AS 2550.1.

The warranty does not cover:

  • damage from misuse, overload, unauthorised modification, or operation outside the duty class specified;
  • wear parts (wire rope, brake pads, contactor tips, light fittings);
  • damage caused by neglect, fire, flood, cyclone, or other force majeure;
  • consequential losses, including loss of production, loss of profits, or cost of standby cranage.

This warranty is in addition to any consumer guarantees that apply under the Australian Consumer Law and does not exclude, restrict or modify those guarantees to the extent they cannot be lawfully excluded.

11. Payment terms

Payment milestones are negotiated on a case-by-case basis and set out on the face of the quotation. Typical structures include staged milestones aligned to order acceptance, completion of fabrication / pre-despatch, and commissioning & handover; the exact split depends on the scope, lead time and value of the order.

Unless otherwise stated on the quotation, invoices are payable 30 days from invoice date to our nominated Australian bank account. Overdue amounts attract interest at 2 % per month or part thereof, and recovery costs are chargeable.

Title in goods supplied passes only on full payment. We retain a Personal Property Securities Act 2009 (Cth) security interest in goods until payment is received.

12. Cancellation

If the client cancels after order acceptance, the client is liable for work performed, materials procured, and subcontractor commitments entered into at the time of cancellation. Deposits are non-refundable once engineering and procurement have commenced.

13. Force majeure

Neither party is liable for delay or failure to perform obligations caused by circumstances beyond its reasonable control, including natural disasters, industrial disputes, pandemics, and government action. Affected obligations are suspended for the duration of the event.

14. Liability

To the maximum extent permitted by law, our liability in connection with any quotation, order or supplied crane is limited to, at our election, repair or replacement of the affected goods, or refund of the price paid for the affected goods. We are not liable for indirect, consequential, special or economic loss.

Nothing in this clause excludes, restricts or modifies rights under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, where those rights cannot be excluded.

15. Governing law

These terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the Australian courts.

16. Entire agreement

These terms together with the written quotation and any signed variations constitute the entire agreement between the parties in relation to the supplied crane, and supersede prior representations. Where the client issues a purchase order containing inconsistent terms, these terms prevail unless expressly agreed in writing by us to the contrary.
